Contest Annoucement: Billie Elish – Hit Me Hard and Soft
Definitions:
Contest – The promotional event described in these official rules.
Sponsor – STYLEFAV, the entity responsible for organizing and conducting the Contest.
Entrant – Any individual who meets the eligibility requirements and participates in the Contest.
Prize – The item(s) awarded to the winner(s) of the Contest. For example, “Two (2) tickets to the Billie Eilish ‘Hit Me Hard and Soft: The Tour’ concert on October 1, 2024, at Scotiabank Arena, Toronto. Each concert ticket is valued at $350 CAD (Canadian Dollar), for a total prize value of $700 CAD.”
Contest Start Date – The date and time when the Contest begins. 11:00 AM Eastern Time (ET) on June 10, 2024.”
Contest End Date – The date and time when the Contest ends. 8:00 PM ET on August 31, 2024.
Contest Period – The time frame during which entries for the Contest will be accepted, as specified in the Contest Start Date and Contest End Date definitions.
Excluded Individuals – Employees, officers, directors, agents, and representatives of the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotional agencies, and legal advisors, as well as their immediate family members (defined as spouses, parents, siblings, and children, regardless of where they live) and those living in the same household of any Excluded Individuals (whether related or not).
Entry – The submission by an Entrant to participate in the Contest, including all required information and adherence to the specified Method of Entry.
Winner – The Entrant selected through the Draw and Selection process who is eligible to receive the Prize, having met all Contest requirements and correctly answered the skill-testing question.
Skill-Testing Question – A mathematical question that must be correctly answered by the selected Entrant to be declared the Winner, as required by Canadian law.
Notification – The process of informing the Winner of their selection, which may include phone calls, emails, and other forms of communication.
Released Parties – The Sponsor and its related companies, and all their respective officers, directors, employees, representatives, and agents who are released from liability by Entrants.
Venue Regulations – The rules and guidelines set forth by the venue where the Prize event will take place, including health and safety requirements and public health guidelines.
Third-Party Services – External platforms or services used in conjunction with the Contest, including but not limited to social media, ticketing services, and other service providers specified in the Contest announcement.
Eligibility Requirements:
This contest is open solely to individuals who are legal residents of Canada, excluding residents of Quebec, and have reached the age of majority in their place of residence at the time of entry. The age of majority in Ontario is 18 years. Therefore, individuals under the age of 18 are not eligible to participate. Employees, officers, directors, agents, representatives of STYLEFAV, its parent companies, subsidiaries, affiliates, advertising and promotional agencies, and legal advisors (the “Excluded Individuals”), their immediate family members (defined as spouses, parents, siblings, and children, regardless of where they live), and those living in the same household of any Excluded Individuals (whether related or not) are also not eligible to participate. This contest is void in Quebec and where prohibited or restricted by law. Any entries from individuals under the age of majority or from residents of Quebec will be disqualified. Entries from individuals who are not legal residents of Canada will also be disqualified.
Contest Period:
The contest commences at the start date and time specified in the “Contest Start Date” definition and concludes at the end date and time specified in the “Contest End Date” definition (“Contest Period”). Entries submitted before or after the Contest Period will be disqualified.
Method of Entry:
No purchase or payment of any kind is necessary to enter or win. A purchase does not enhance the chance of winning. Entrants must visit the STYLEFAV store located at the address specified in the contest announcement during the Contest Period. To enter, participants are required to sign up for the STYLEFAV loyalty program, which is free and requires a valid phone number and email address. Additionally, entrants must follow at least one of STYLEFAV’s social media accounts on platforms specified in the contest announcement. By signing up for the STYLEFAV loyalty program, participants provide their explicit consent to receive commercial electronic messages from STYLEFAV in compliance with Canada’s Anti-Spam Legislation (CASL). Upon completion of these steps, entrants will receive one (1) contest entry ticket from a store representative.
There is a limit of one (1) entry per person during the Contest Period. Participants can unsubscribe from marketing communications at any time by following the instructions provided in the marketing emails or by contacting customer service.
Prize Description:
The prize for this contest is specified in the “Prize” definition. The winner must possess a valid account on the platform specified for prize distribution to receive the prize. The prize is non-transferable and cannot be exchanged for cash or alternative prizes. Winners are responsible for all additional expenses not explicitly included in the prize description, including but not limited to transportation, accommodation, meals, insurance, and any other personal expenses. STYLEFAV is not responsible for the reimbursement of any additional costs incurred by the winner in relation to claiming or using the prize. Winners must comply with all venue regulations, including health and safety requirements, public health guidelines, and any other rules imposed by the venue or public authorities if applicable. The prize is subject to any terms and conditions imposed by the issuer. Any taxes on the prize are the sole responsibility of the winner. STYLEFAV makes no warranty or representation, either expressed or implied, in respect to any prize. STYLEFAV is not responsible for any defect or failure in the prize.
Draw and Selection of Winner:
The winner will be determined by a random draw conducted by STYLEFAV or its designated representative on the date specified in the contest announcement, from all eligible entries. To be declared the winner, the selected entrant must correctly answer, unaided, a time-limited mathematical skill-testing question administered over the phone or as specified.
Winner Notification:
The winner will be notified via the phone number provided at the time of entry within three (3) business days of the draw. If the winner does not respond within forty-eight (48) hours, fails to correctly answer the skill-testing question, or declines the prize, the prize may be forfeited and an alternative winner may be selected at STYLEFAV’s discretion. Following the initial phone call, a confirmation email will be sent to the winner’s provided email address. All contest-related notifications and communications will be conducted via phone and email. It is the participant’s responsibility to ensure that their phone number and email address are valid and capable of receiving notifications.
Odds of Winning:
The odds of winning depend on the number of eligible entries received during the Contest Period.
General Conditions:
This contest is governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. STYLEFAV reserves the right to cancel, suspend, or modify the contest if fraud, technical failures, or any other factor beyond STYLEFAV’s control impairs the integrity or proper conduct of the contest. Entries not complying with all rules are subject to disqualification. Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different identities, registrations, addresses, or any other methods will void that entrant’s entries and that entrant may be disqualified. Fraudulent entries or entries not complying with these official rules will be disqualified at the sole discretion of STYLEFAV. STYLEFAV reserves the right to make administrative decisions, including disqualification and rule changes, without prior notice to participants. Participants must not engage in any defamatory, offensive, or illegal conduct on social media platforms in relation to the contest and such behavior can result in disqualification. Participants agree to indemnify STYLEFAV for any claims, damages, liabilities, and expenses arising out of their participation in the contest or use of the prize. By participating, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action.
Release and Limitations of Liability:
By participating in the contest, each entrant agrees to release, indemnify, and hold harmless STYLEFAV, its related companies, and all their respective officers, directors, employees, representatives, and agents (the “Released Parties”) from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such entrant’s participation in the contest and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof. This includes any travel related thereto, any aspect of attendance at events or any other related activities, including but not limited to personal injury, death, damage to personal property, or any other loss or damage. Additionally, the Released Parties are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in the contest. Further, the Released Parties are not responsible for any incorrect or inaccurate information, whether caused by website users, tampering, hacking, or by any equipment or programming associated with or utilized in the contest. STYLEFAV is also not responsible for any issues arising from the use of third-party services, including but not limited to availability, delivery issues, or the failure of the third-party service to honor any aspect of the prize. Entrants waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, indirect, or direct damages, including loss of opportunity, loss of enjoyment, or any other intangible losses. By participating, entrants agree that any and all disputes, claims, and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action.
Privacy and Personal Information:
Personal information collected from entrants, including phone numbers and email addresses, is used only for the purpose of administering the contest, awarding the prize, and sending marketing communications if consent is given. Personal information will be securely stored and handled using industry-standard security measures to protect against unauthorized access, disclosure, or misuse. By entering the contest, participants consent to receive marketing communications from STYLEFAV. Participants can unsubscribe from these communications at any time by following the instructions provided in the marketing emails or by contacting customer service. Consent to collect, use, and disclose entrants’ personal information may be withdrawn at any time, subject to legal or contractual restrictions and reasonable notice. Any changes to the privacy policy will be communicated to participants, and continued participation will constitute acceptance of the new terms.
Intellectual Property Rights:
By entering this contest, each participant grants STYLEFAV a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, publish, display, reproduce, and distribute any materials submitted with their entry in all media formats.
Dispute Resolution:
In the event of a dispute arising out of or in connection with this contest, the parties agree to first attempt to resolve the dispute through friendly negotiations. If the dispute cannot be resolved informally, the parties agree to resolve any claims or disputes through binding arbitration, to be conducted in accordance with the Arbitration Act of Ontario. The arbitration will be conducted in Toronto, Ontario, before a single arbitrator, and will be held in the English language. The decision of the arbitrator will be final and binding on the parties, and no party shall have the right to appeal such decision. Each party will bear their own legal costs related to the arbitration proceedings, unless otherwise determined by the arbitrator. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof. This arbitration clause shall not preclude parties from seeking provisional remedies in aid of arbitration from a court of appropriate jurisdiction. Any legal disputes that are not subject to arbitration as outlined above must be resolved in the courts of Ontario, and the contest shall be governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. This jurisdiction provision applies to all contests conducted by STYLEFAV, unless otherwise specified.
Class Action Waiver:
By participating in this contest, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action. Entrants further agree that under no circumstances will they be entitled to obtain awards for, and hereby waive all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
Severability:
If any provision of these contest rules is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these rules, which shall remain in full force and effect.
Force Majeure and Cancellation:
STYLEFAV is not responsible for any failure to conduct the contest as planned due to events beyond its control, including but not limited to natural disasters, acts of terrorism, government restrictions, pandemics, cyber-attacks, strikes, or any other events that could impact the administration, security, fairness, integrity, or proper conduct of the contest. In such cases, STYLEFAV reserves the right to cancel, terminate, modify, or suspend the contest without prior notice or obligation. Specific examples include but are not limited to:
– Government-imposed lockdowns or restrictions due to a pandemic that prevent the event from occurring.
– Natural disasters such as earthquakes, floods, or hurricanes that disrupt normal operations.
– Strikes or labor disputes affecting the ability to carry out the contest or award the prize.
– Cyber-attacks or other security breaches that compromise the contest’s integrity.
– Acts of terrorism or civil unrest that pose a risk to public safety.
If any of these events occur, STYLEFAV will notify participants as soon as possible through the same channels used for contest entry, including updates on STYLEFAV’s website, social media platforms, and by email. Continued participation in the contest following such notification will constitute acceptance of the modified terms.
Non-Affiliation:
This contest is not sponsored, endorsed, administered by, or associated with any third-party entities or individuals mentioned in the contest announcement, including but not limited to artists, venues, ticketing services, or any of their agents.
Acceptance of Rules:
By participating in the contest, each entrant agrees to and fully accepts these official contest rules and the decisions of the contest organizers, which are final and binding in all matters related to the contest.
Prize Substitution:
STYLEFAV reserves the right to substitute a prize (or a component thereof) for one of equal or greater value if the advertised prize becomes unavailable for reasons beyond STYLEFAV’s control. This includes, but is not limited to, supply disruptions, event cancellations, or unforeseen circumstances. STYLEFAV also reserves the right to modify the prize details if necessary, while ensuring that any changes do not diminish the overall value of the prize. Participants will not be entitled to any additional compensation in the event that the substitution prize is of greater value than the original prize.
Legal Disclaimers:
STYLEFAV is not responsible for any typographical or other errors in the offer or administration of this contest, including, but not limited to, errors in advertising, the Official Contest Rules, the selection and announcement of the winner, or the distribution of the prize. STYLEFAV makes no representations or warranties concerning the appearance, safety, or performance of any prize awarded. All contest materials are provided ‘as is’ without express or implied warranty.
Third-Party Platform Rules:
This contest may be promoted on social media platforms, including but not limited to TikTok, Facebook, Instagram, and on YouTube. Participants must comply with the terms and conditions of these platforms. STYLEFAV is not responsible for any actions or inactions by a third-party platform that may affect the conduct or administration of the contest. This contest is in no way sponsored, endorsed, or administered by, or associated with, TikTok, Instagram, or YouTube.
Third-Party Terms:
Participants must also comply with the terms and conditions of third-party platforms or services used in the contest, including but not limited to any ticketing, social media, or other service providers specified in the contest announcement. STYLEFAV is not responsible for any issues arising from participants’ failure to adhere to these terms and conditions. Any third-party services used in the contest are provided by independent contractors, and STYLEFAV is not responsible for their actions.
Handling of Disqualifications:
STYLEFAV reserves the right to disqualify any participant found to be tampering with the entry process or the operation of the contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Reasons for disqualification include, but are not limited to, providing false information on entry forms, attempting to disrupt the contest or circumvent the rules, and engaging in fraudulent or criminal activities. Failure to comply with the contest rules may result in disqualification at any stage, including after the prize has been awarded. If disqualified, the participant forfeits all rights to any prizes.
Disqualification Appeals Process:
Participants who have been disqualified may appeal the decision by submitting a written appeal to STYLEFAV’s customer service within five (5) business days of receiving the disqualification notice. The appeal must include the participant’s full name, contact information, and a detailed explanation of why they believe the disqualification was incorrect. STYLEFAV will review the appeal and respond within ten (10) business days. All decisions made by STYLEFAV regarding appeals are final.
Limitations Period for Claims:
Any legal claim or dispute arising out of or related to the contest must be filed within sixty (60) days after such claim or cause of action arose, regardless of any statute or law to the contrary. Failure to file a claim within this period will result in the permanent barring of the claim.
Accessibility and Accommodation:
STYLEFAV is committed to ensuring that our contests are accessible to all eligible participants, including those with disabilities. However, participants should be aware that certain prizes may not specifically accommodate individuals with certain disabilities. Marketing Communications and Opt-In Policy:
Signing up for the STYLEFAV loyalty program during the contest entry process does not automatically enroll participants in receiving marketing communications. Participants must explicitly opt-in to receive promotional emails, messages, or other forms of communication from STYLEFAV. An option to opt-in will be provided at the time of signing up for the loyalty program, and participants may choose whether or not to receive marketing materials.
Participants who choose to opt-in can withdraw their consent and unsubscribe from receiving marketing communications at any time through the unsubscribe link provided in each marketing email or by contacting our customer service directly. STYLEFAV is committed to respecting the choices of our customers and will ensure that opting out is as straightforward as opting in.
Confirmation of Eligibility and Compliance:
Upon selection, potential winners are required to complete and sign a Declaration of Eligibility and Compliance form to confirm their compliance with the contest rules and verify their eligibility. This form must be returned to STYLEFAV within a specified timeframe, typically within five (5) business days from the date of notification. To facilitate a quick and efficient process, this form can be signed electronically, using a secure e-signature platform provided by STYLEFAV.
The form will require winners to affirm that they have met all the eligibility requirements and adhered to all the contest rules, including not being part of the excluded categories of employees, family members, or those living in the same household of excluded individuals.
Winners must also verify their identity through Stripe’s Identity Verification service. The provided identity data will be securely stored for up to sixty (60) days and will then be permanently deleted.
Failure to return this completed form within the specified timeframe, or failure to meet all contest rules and regulations, may result in disqualification, and an alternate winner may be selected. This process is designed to ensure fairness in the contest and to maintain integrity by verifying that all winners are qualified to receive their prizes under the contest terms. The use of e-signatures in this process is in compliance with electronic transactions laws applicable in Ontario and Canada, ensuring that the digital signing process is as legally binding as a traditional paper and ink signature.
Publicity Release:
By accepting the prize, the winner grants STYLEFAV and its affiliates the right to use the winner’s name, likeness, photograph, voice, opinions, and hometown for internal promotional purposes and for verifying the contest’s transparency, without further payment or consideration. This consent isprovided without the need for additional documentation or approval.
Compliance with Laws:
This contest is subject to all applicable federal, provincial, and municipal laws and regulations. Participants agree to comply with all applicable laws, including but not limited to those governing privacy, data protection, and marketing communications.
Data Retention and Removal:
Identity verification data collected through Stripe’s Identity verification service will be securely stored and handled in compliance with industry standards and applicable privacy laws. This data will be retained for a period of sixty (60) days from the date of verification to allow for any necessary auditing or compliance checks. After this period, all identity verification data will be permanently deleted from STYLEFAV’s records.
Withdrawal of Participation:
Participants who wish to withdraw from the contest after entering may do so by contacting STYLEFAV customer service via the phone number or email address registered for the contest entry. The request must include the participant’s full name, phone number, and email address used for the entry. Upon receipt of the withdrawal request, STYLEFAV will remove the participant’s entry from the contest within three (3) business days, and the participant will no longer be eligible to win the prize. Withdrawal from the contest does not automatically unsubscribe participants from marketing communications, which must be done separately by following the instructions provided in the marketing emails or by contacting customer service.
Compliance with Anti-Spam Laws:
This contest complies with Canada’s Anti-Spam Legislation (CASL). Participants will not receive unsolicited messages from STYLEFAV unless they have explicitly opted in to receive such communications.
Public Health Crisis Contingency:
In light of ongoing public health uncertainties, STYLEFAV reserves the right to adjust or cancel the contest and prize distribution if new health advisories or regulations are issued that impact the ability to safely conduct the contest or the winner’s ability to use the prize. This includes, but is not limited to, changes in public health guidelines, government restrictions, or venue-specific rules. In such cases, STYLEFAV will notify participants as soon as possible through the same channels used for contest entry, including updates on STYLEFAV’s website, social media platforms, and by email.
Modification of Terms:
STYLEFAV reserves the right to modify the terms and conditions of this contest at any time, especially if significant changes occur after the contest has started. Participants will be notified of any significant changes through the same channels used for contest entry, including updates on STYLEFAV’s website, social media platforms, and by email. Continued participation in the contest following such notification will constitute acceptance of the modified terms. If a participant does not agree to the modified terms, they may withdraw from the contest by contacting STYLEFAV customer service as outlined in the “Withdrawal of Participation” section.
Void Where Prohibited:
This contest is void where prohibited by law.
Contest Rules Availability:
The full contest rules are available at all times on the STYLEFAV website. Additionally, a printed copy of the full contest rules can be requested at the STYLEFAV store located at 5170 Yonge Street, North York, Ontario, M2N 5P6, Canada.
Prize Acceptance Agreement:
The winner may be required to sign an agreement acknowledging acceptance of the prize and adherence to all contest rules.
Taxation of Prizes:
Any taxes on the prize are the sole responsibility of the winner. STYLEFAV will not be responsible for reporting or paying any taxes related to the prize.
Reservation of Rights:
STYLEFAV reserves the right to take any action necessary to comply with applicable laws and regulations.
Communication Opt-Out:
Participants who choose to opt-in to receive marketing communications from STYLEFAV can withdraw their consent and unsubscribe at any time through the unsubscribe link provided in each marketing email or by contacting our customer service directly. This opt-out option is available at any time, even if participants initially opted in to receive such communications.
Compliance with Terms:
By participating in the contest, participants agree to comply with all terms and conditions outlined in the official contest rules and any other applicable rules and regulations.
STYLEFAV reserves the right to cancel, amend, or suspend the contest, or to amend these rules, without prior notice or obligation, in the event of any accident, administrative error, printing error, or any other error, or any event that affects the administration, security, fairness, integrity, or proper conduct of the contest, including but not limited to: natural disasters, pandemics, strikes, or political unrest. If significant changes are made, STYLEFAV will notify all participants as quickly as possible through the same channels used for contest entry, including but not limited to, updates on STYLEFAV’s website, social media platforms, and by email. Continued participation in the contest following such notification will constitute acceptance of the modified terms. Every effort will be made to keep participants informed of significant changes to the contest structure, including but not limited to changes in the contest period or prize details.
