1. Definitions:
- Contest: The promotional event described in these official rules.
- Sponsor: The entity responsible for organizing and conducting the Contest.
- Entrant: Any individual who meets the eligibility requirements and participates in the Contest.
- Prize: The item(s) awarded to the winner(s) of the Contest, as specified in the Contest announcement.
- Contest Start Date: The date and time when the Contest begins, as specified in the Contest announcement.
- Contest End Date: The date and time when the Contest ends, as specified in the Contest announcement.
- Contest Period: The time frame during which entries for the Contest will be accepted, as specified in the Contest Start Date and Contest End Date definitions.
- Excluded Individuals: Employees, officers, directors, agents, and representatives of the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotional agencies, and legal advisors, as well as their immediate family members (defined as spouses, parents, siblings, and children, regardless of where they live) and those living in the same household of any Excluded Individuals (whether related or not).
- Entry: The submission by an Entrant to participate in the Contest, including all required information and adherence to the specified Method of Entry.
- Winner: The Entrant selected through the Draw and Selection process who is eligible to receive the Prize, having met all Contest requirements and correctly answered the skill-testing question.
- Skill-Testing Question: A mathematical question that must be correctly answered by the selected Entrant to be declared the Winner, as required by Canadian law.
- Notification: The process of informing the Winner of their selection, which may include phone calls, emails, and other forms of communication.
- Released Parties: The Sponsor and its related companies, and all their respective officers, directors, employees, representatives, and agents who are released from liability by Entrants.
- Venue Regulations: The rules and guidelines set forth by the venue where the Prize event will take place, including health and safety requirements and public health guidelines.
- Third-Party Services: External platforms or services used in conjunction with the Contest, including but not limited to social media, ticketing services, and other service providers specified in the Contest announcement.
2. Eligibility Requirements:
This Contest is open solely to individuals who are legal residents of Canada, excluding residents of Quebec, and have reached the age of majority in their place of residence at the time of entry. Employees, officers, directors, agents, representatives of the Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotional agencies, and legal advisors (the “Excluded Individuals”), their immediate family members (defined as spouses, parents, siblings, and children, regardless of where they live), and those living in the same household of any Excluded Individuals (whether related or not) are also not eligible to participate. This Contest is void in Quebec and where prohibited or restricted by law.
3. Contest Period:
The Contest commences at the start date and time specified in the “Contest Start Date” definition and concludes at the end date and time specified in the “Contest End Date” definition. Entries submitted before or after the Contest Period will be disqualified.
4. Method of Entry:
No purchase or payment of any kind is necessary to enter or win. A purchase does not enhance the chance of winning. Entrants must follow the instructions provided in the Contest announcement, which may include signing up for a loyalty program, following social media accounts, or other specified actions. By participating, Entrants consent to receive commercial electronic messages from the Sponsor in compliance with Canada’s Anti-Spam Legislation (CASL). There is a limit of one (1) entry per person during the Contest Period.
5. Prize Description:
The Prize for this Contest is specified in the “Prize” definition. The Winner must possess a valid account on the platform specified for Prize distribution to receive the Prize. The Prize is non-transferable and cannot be exchanged for cash or alternative prizes. Winners are responsible for all additional expenses not explicitly included in the Prize description, including but not limited to transportation, accommodation, meals, insurance, and any other personal expenses. Winners must comply with all Venue Regulations and any other rules imposed by the venue or public authorities if applicable. Any taxes on the Prize are the sole responsibility of the Winner.
6. Draw and Selection of Winner:
The Winner will be determined by a random draw conducted by the Sponsor or its designated representative from all eligible entries received during the Contest Period. To be declared the Winner, the selected Entrant must correctly answer, unaided, a time-limited mathematical skill-testing question.
7. Winner Notification:
The Winner will be notified via the contact information provided at the time of entry. If the Winner does not respond within the specified timeframe, fails to correctly answer the skill-testing question, or declines the Prize, the Prize may be forfeited, and an alternative Winner may be selected at the Sponsor’s discretion.
8. Odds of Winning:
The odds of winning depend on the number of eligible entries received during the Contest Period.
9. General Conditions:
This Contest is governed by and construed in accordance with the laws of Ontario and the laws of Canada applicable therein. The Sponsor reserves the right to cancel, suspend, or modify the Contest if fraud, technical failures, or any other factor beyond the Sponsor’s control impairs the integrity or proper conduct of the Contest. Entries not complying with all rules are subject to disqualification.
10. Release and Limitations of Liability:
By participating in the Contest, Entrants agree to release, indemnify, and hold harmless the Sponsor, its related companies, and all their respective officers, directors, employees, representatives, and agents from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur from participation in the Contest and/or acceptance, possession, use, or misuse of the Prize.
11. Privacy and Personal Information:
Personal information collected from Entrants is used only for the purpose of administering the Contest, awarding the Prize, and sending marketing communications if consent is given. Participants can unsubscribe from marketing communications at any time.
12. Intellectual Property Rights:
By entering this Contest, each participant grants the Sponsor a non-exclusive, perpetual, irrevocable, worldwide, royalty-free license to use, publish, display, reproduce, and distribute any materials submitted with their entry in all media formats.
13. Dispute Resolution:
In the event of a dispute arising out of or in connection with this Contest, the parties agree to resolve any claims or disputes through binding arbitration conducted in Toronto, Ontario. The decision of the arbitrator will be final and binding.
14. Class Action Waiver:
By participating in this Contest, each Entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Contest or any Prize awarded shall be resolved individually, without resort to any form of class action.
15. Severability:
If any provision of these Contest rules is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these rules.
16. Force Majeure and Cancellation:
The Sponsor is not responsible for any failure to conduct the Contest as planned due to events beyond its control, including but not limited to natural disasters, acts of terrorism, government restrictions, pandemics, cyber-attacks, strikes, or any other events that impact the administration, security, fairness, or integrity of the Contest.
17. Non-Affiliation:
This Contest is not sponsored, endorsed, administered by, or associated with any third-party entities or individuals mentioned in the Contest announcement.
18. Acceptance of Rules:
By participating in the Contest, each Entrant agrees to and fully accepts these official Contest rules and the decisions of the Contest organizers, which are final and binding in all matters related to the Contest.
19. Prize Substitution:
The Sponsor reserves the right to substitute a Prize (or a component thereof) for one of equal or greater value if the advertised Prize becomes unavailable.
20. Legal Disclaimers:
The Sponsor is not responsible for any typographical or other errors in the offer or administration of this Contest, including errors in advertising, the Official Contest Rules, the selection and announcement of the Winner, or the distribution of the Prize.
21. Third-Party Platform Rules:
Participants must comply with the terms and conditions of any third-party platforms or services used in the Contest.
22. Handling of Disqualifications:
The Sponsor reserves the right to disqualify any participant found to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner.
23. Accessibility and Accommodation:
The Sponsor is committed to ensuring that our contests are accessible to all eligible participants, including those with disabilities. Participants should contact the Sponsor if they require any accommodations.
24. Communication Opt-Out:
Participants can withdraw their consent and unsubscribe from receiving marketing communications at any time.
25. Compliance with Terms:
By participating in the Contest, participants agree to comply with all terms and conditions outlined in the official Contest rules and any other applicable rules and regulations.
